Exorbitant Jurisdiction in the Context of Recognition and Enforcement of Foreign Court Judgments
Abstract
In terms of disputes involving foreign elements, it’s necessary both to determine which country's courts will have jurisdiction over the case and to ensure that the decision resulting from the trial will be valid in other countries. The recognition and enforcement of foreign court judgments are regulated by the domestic laws each country. However, although these procedures are governed by national legislation, countries cannot completely isaolate themselves from international standards. Nonetheless, since the determination of international jurisdiction is left to easch country’s legal system, the authority recognized under the law of the country where recognition and enforcement are sought may be regarded as a transcendent authority, potentially hindering enforcement. Therefore it is essential to understand what international jurisdivtion entails, how it is regulated and how it is applied in practice. In Turkish law the recognition and enforcement of foreign judgments are primarily governde by Articles 50-59 of the International Private and Procedural Law(MÖHUK). In this study, the concept of international jurisdiction will first be explained. Then, the conditions on the recognition and enforcement under MÖHUK will be examined, with particular focus on the jurisdictional requirements and the legal approaches surrounding them.
